In August 2009 we signed documents so that Pacific Loan Solutions could start a loan modification process for us. They have failed to complete the modification on our behalf. Their delay in asking us for additional documents caused Wachovia (our lender) to close our file on 10/18/09. We are now in "pre-forclosure" status with Wachovia and are receiving daily phone calls from them. We were notified about the additional documents needed and hand carried these into the Pacific Loan Solutions office. They misplaced the documents and finally found them in our son's file last week. The documents were faxed to Wachovia on 11/17...but the file is still in closed status. Today, Wachovia tells us that we can reopen the file ourselves for free. We paid Pacific Loan Solutions $6,000 in advance for their services. My concern is...can we get our money back for their failure to complete their services? We need an immediate answer so we can complete the modification process directly with Wachovia. How can we force this company to fulfill their promise to complete the modification process?
