I ordered two 400mAh iPod Nano 2nd Gen Batteries manufactured by Ipod Battery Depot. What I received was 2 generic 350mAh "made in China" batteries.
Since when is bait and switch legal? Their product detail specifically states why there product is better than the competitors - link - http://www.ipodbatterydepot.com/shopping/productdetails.asp?recordid=48
[400mAh not 350mAh - Manufactured by us not some random China manufacturer]
So I buy on that detail and they send me with no prior notification their competitors inferior 350mAh "Made in China" product.
When I called there sales person she stated they Sell only 400mAh batteries for 2nd Gen Ipod Nanos - I couldn't order a 350mAh battery for it if I wanted to.
What's worse is the shipping invoice "in house" product numbers match the numbers on the product box and the battery itself indicating this was a deliberate send not a justifiable mix-up.
They then expect me to Pay the return shipping and wait indefinitely (with promises) for a product they may never have had,
Or Pay the return shipping and Pay a restocking fee to get a refund (minus shipping) on an item they bait and switched on me.
Is there any recourse? Is "bait and switch" a legal business practice in today's market?
Update: I filed a complaint with the BBB which assisted in a quick (before they received the returned items) total refund (items + Shipping). I'm still out the the return shipping.
